British EU candidate arrested for “racial harassment” for quoting Winston Churchill’s anti-Islamic views

Election candidate arrested over Churchill speech – Telegraph


Paul Weston a member of Great Britain’s Liberty Party was arrested both for delivering a speech in public and on charges of “suspicion of racial harassment”.
The former charge apparently derives from a requirement to have some kind of permit before speaking with a blow horn.
The latter charge was apparently because Weston dared to quote Winston Churchill’s book The River War in which Churchill made derogatory remarks about Islam :

How dreadful are the curses which Mohammedanism lays on its votaries! Besides the fanatical frenzy, which is as dangerous in a man as hydrophobia in a dog, there is this fearful fatalistic apathy. The effects are apparent in many countries. Improvident habits, slovenly systems of agriculture, sluggish methods of commerce, and insecurity of property exist wherever the followers of the Prophet rule or live. A degraded sensualism deprives this life of its grace and refinement; the next of its dignity and sanctity. The fact that in Mohammedan law every woman must belong to some man as his absolute property — either as a child, a wife, or a concubine — must delay the final extinction of slavery until the faith of Islam has ceased to be a great power among men. Thousands become the brave and loyal soldiers of the faith: all know how to die but the influence of the religion paralyses the social development of those who follow it. No stronger retrograde force exists in the world. Far from being moribund, Mohammedanism is a militant and proselytizing faith.

Where is the incitement racial or otherwise? Certainly Churchill overstates since there are many Muslims to whom these charges are inapplicable ( indeed there are those among Muslims who fight against these evils.) But is this passage so wildly inaccurate when leveled at the governments of Saudi Arabia, Pakistan or Iran? Do we not witness rampant misogyny ,backwardness, & fanaticism in the Islamic World on a daily basis? Have we not seen mobs of BRITISH Muslims (literally) screaming for Danish blood with chants of “die die Denmark” in response to the cartoons ridiculing Mohammed? I myself have posted numerous examples of these evils on my blog.
In any event the word incitement has an actual legal meaning in the U.S.: speech whose purpose can be objectively shown to be to persuade people to commit violent criminal acts in the here & NOW –denouncing a religion is not incitement . Calling on your audience to commit murder IS. (whether or not the call was motivated by racism or religion).
If you use your right of free speech to condemn Islam ( or Judaism or Christianity) you are not guilty of “incitement” because some fanatic decides to murder you .
It is the fanatic who must be stopped, not appeased.
But this grasp of free speech has been thrown out the window in Europe ,where instead of protecting the free speech rights of Weston ,they do the work of his critics by seeking to silence him by force.

Author’s note: Nothing I say should be taken of as even a semi- endorsement of Weston ‘s beliefs beyond what I have stated,(which concern the Churchill quote) I do not know of ,nor do I endorse his other statements & for all I know they may be loathsome to me . But nothing in the Churchill quote justifies imprisonment & if Weston made some other comment that is a genuine incitement to mob violence it is not mentioned in the article.

I continue to be perplexed that more people do not see the obvious dangers in having the government subsidize ”news” & ”educational programming” which is often thinly veiled propaganda. It makes no difference whether I agree with a particular program or not,and the situation would not be ”solved” by having the government promote conservative ideas instead of liberal ideas or having it promote them both equally. Nor is this ”just another violation of rights” this directly impinges on free speech rights. Yet I continue to encounter this attitude of ”its no big deal” or ”PBS has good programming” . Who cares? We have a set of government subsidized television channels. The danger that that poses cannot be exaggerated.

Perhaps 100,000, an estimate based on the number of top officials ruling the most authoritarian countries, whose power is threatened by the open Web. Under the one country, one vote rule of the U.N., these 100,000 people trump the rest of the two billion. It only takes a majority of the 193 countries in the U.N. to hijack the Internet. The International Telecommunications Union is hosting a conference in Dubai, where many countries are eager to extend the agency’s role beyond telecommunications to regulate the Internet. The two -week conference is half over, with meddlesome proposals from China, Russia and other authoritarian regimes dominating the discussion. A U.S. -Canadian proposal would have limited topics to telecommunications, excluding the Internet. Top U.S. negotiator Terry Kramer said in a call with the media last week that the State Department believes that “fundamentally, the conference should not be dealing with the Internet” and that the U.S. team was working “day and night” to find allies. But State didn’t respond to my follow-up question asking for an estimate of how many countries have pledged to keep hands off the Internet. This is likely a low percentage of the 193. Instead, authoritarian governments want to legitimize government censorship, tax Internet traffic that crosses national boundaries and mandate that ITU bureaucrats replace the nongovernmental engineering groups now smoothly running the Internet.

Does the government have the right to prohibit real or imagined lies,even when no fraud is involved?

RRD:The Stolen Valor act signed into law by George W.Bush,makes it a crime to falsely claim that you served in the military.Apparently this is the case even if no fraud (financial gain) was involved and even if it is not for the purpose of espionage or sabotage.

While I find these liars despicable,I find many things despicable,the fact that I regard something as despicable does not mean that the government should prohibit it,or that it has the right to do so.

The case is coming before the Supreme Court.Alvarez is the name of the person challenging the law(he is one of those who boasted of medals they have not earned).

”The federal court of appeals in San Francisco ruled in his favor in two separate opinions. Now the case will go to the Supreme Court, where the Obama administration will argue that the First Amendment does not protect lies as it does true statements.

Under this logic, Congress would be able to criminalize statements solely because they are lies, alleging some type of amorphous social harm. ”….

RRD:I am not a lawyer & have not read the briefs,but if Mr.Turley is correct then this has ramifications that go far beyond whether someone can falsely claim to be soldier.
What is equally bizarre is the contention of some of the bill’s supporters that men who risk death(or die)do so for the sake of medals.A claim that flies in the face of the overt statements of many medal awardees.

….”Supporters of the bill insist that prosecutions are needed to maintain the value and dignity of our military citations.The Congressional Medal of Honor Foundation has taken this argument one step further in its amicus brief to the Supreme Court. It says these medals are not just recognitions of heroism but the very inducement for heroism. It chastised the federal court for its “lack of appreciation” when the court said it was insulting to suggest that heroes are motivated by the desire for medals. The foundation insisted that heroes do seek these medals in risking their lives, curiously citing the tradition of Roman generals giving spears and cups to soldiers who distinguished themselves in battle.”….

RRD:First I agree that it is unjust and insulting for those who have not earned these medals to claim to have won them it is no more so than to write editorials that insult our soldiers and denounce them as rapists and murderers,something which I believe is protected speech and should remain protected speech.
Second while it is certainly true that men–particularly young men– often join the military with visions of “glory” in their heads,such notions are quickly disabused by military service.

There is heroism in military service,there is nobility,but there is little of the green recruit’s vision of “glory”.And if you have reached the point where you are worthy of receiving a medal you most likely have more pressing things on your mind then medals:things like keeping your bleeding friends alive,while holding off the enemy.

This is harrowing and nightmarish.

It is not some kind of game show where people win prizes.

Most likely the soldier wishes that he had never been put in that kind of nightmarish position.

We give medals because it is just and right to honor the service and valor of men,not because such valor would not exist without the medals.

In fairness to the Congressional Medal of Honor Foundation
,perhaps they knew that this argument made no sense,but wanted to “cover all the bases” to ensure that the bill is upheld,and were motivated by concern for the memory of the dead and living awardees.

[Update 1/09/10 10:29pm:In response to some legitimate criticism of the structure of the post,( I believe “incoherent” was the word used),I intend to edit & clarify the post,& update it by tomorrow evening.In the interim,it can be used as a list of links to past vitriolic attacks on the Right by some on the Left.These attacks did not seem to lead to the same level of concern,which we see today,about
whether harsh rhetoric could lead to violence.(Though some on the right did).Indeed,I seem to recall many on the Left expressing the view that not only was dissent not unpatriotic,It was inherently patriotic,(essentially regardless of the context).
I also do not recall any efforts by the right to have the Government suppress criticism.
As you can see in the links below,(as well as the photos at the bottom):there were numerous calls for Bush’s death,& Cheney’s death,torture etc.(in some cases from prominent individuals).Recently we have seen misogynistic filth from Playboy,directed towards conservative women.
During the election many people,(including myself),rightly condemned racist attacks on Obama,(showing him eating a watermelon),yet there was also a “rape joke” about Palin,as well as vile T-shirts attacking her.

The list of invective,some of it openly advocating & justifying violence is quite long.(See the links)

There are those on the Right who regard the Left as consisting of a gang of sociopaths who seek to exploit human suffering in order to achieve power over others. Some on the Left seem determined to prove them right.
No sooner had word broke of the Giffords shooting there were those on the Left seeking to ascribe blame for this horror to a particular ideological group.
How soon they forget.Or perhaps they think the smears,& violent fantasies(listed below),as well as actual crimes motivated by Leftist ideologies are morally justifiable.

RRD:Never let a crisis,or the shooting of your colleague,go to waste.
Even if it were true that the shooter were ideologically motivated (which I don’t believe),what of it? The Unabomber was ideologically motivated.
Bill Ayers was ideologically motivated.
James Lee was ideologically motivated.
The only person responsible for this crime is the shooter himself.
Unless,(as I believe),he is insane,in which case no one is to blame.If rhetoric killed people,the left would have killed Bush a thousand times over,(as I show below).Based on their silence when vitriol was poured out against the right,I can come to no other conclusion other than that their outbursts are a dispicable attempt exploit Giffords’ shooting to intimidate their critics.It may even presage a attempt at censorship.

RRD:I take issue with Geller’s assertion that he is a “Lefty nut”.He is not a “Lefty nut”,he is not a “Righty nut”,he is a nut,nut.

Anyone who posts these types of incoherent videos,(in which he babbles about B.C. & B.C.E. & A.D. & A.D.E.,)is certifiable.(Incidentally,22 is about the age that schizophrenia kicks in.But that is only a hypothesis)

Ascribing a political motvation to this man is as absurd as blaming Catcher in the Rye for John Lennon’s assasination.
This man is not even “crazy” in the sense of a Unabomber,or Mcveigh,he is literally insane.

Having addressed that canard,let us take a stroll through memory lane,shall we?
